Terms of Service
The short version: use DupVid only with videos and photos you have the rights to, including permission from anyone in them. Don't make sexual content, content involving minors, or videos that impersonate or deceive people. You keep the rights to what you upload. Subscriptions renew through Apple until you cancel, and credits have no cash value.
1. Agreement
These Terms are an agreement between you and Leadonly OÜ, a company registered in Estonia ("DupVid", "we", "us") about your use of the DupVid app and website (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use DupVid.
2. Eligibility
You must be at least 13 years old. If you're under the age of digital consent or the age of majority where you live (for example, under 16 in some EU countries), you may only use DupVid with your parent's or guardian's permission, and they accept these Terms on your behalf. If you use DupVid for a business, you confirm you're authorized to accept these Terms for it.
3. Your account
DupVid creates an anonymous account for you on your device. You're responsible for activity on your device and account. Because your account isn't tied to an email, deleting the app or losing your device may mean losing access to your content. We can't always recover it. You can delete your account and data at any time in the app (Menu → Delete my data).
4. Your content
What you upload. You keep ownership of the videos, photos and text you add ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, process, transmit and modify Your Content, including by sending it to our AI providers, only to operate and improve the Service for you, and to keep it safe. This license ends when you delete Your Content, except where we must keep it by law.
Your promise. Each time you upload or share content to DupVid, you confirm that:
- you own it or have all the rights, licenses and permissions needed to use it this way;
- you have the consent of every identifiable person who appears in it, including to have their likeness altered or replaced; and
- using it in DupVid doesn't violate anyone's copyright, trademark, privacy, publicity or other rights, or any law.
What DupVid creates. Subject to these Terms and to the rights of others in Your Content, you may use the videos DupVid generates for you ("Outputs") for personal and commercial purposes. Outputs may resemble content created for others, and you're responsible for how you use and publish them, including following the rules of the platforms you post to.
5. Acceptable use
You may not use DupVid to create, upload or share content that:
- is sexual or sexually explicit, or sexualizes anyone;
- shows, involves or appears to involve anyone under 18;
- uses a real person's face, body or voice without their consent, or impersonates a real person, including public figures;
- is intended to deceive, defraud or mislead, such as fake endorsements, fake news or political disinformation;
- harasses, threatens, bullies, defames or discriminates against anyone;
- promotes violence, self-harm, terrorism, or illegal activity;
- infringes copyright, trademarks or other intellectual property rights;
- violates anyone's privacy or reveals personal information without consent.
You also may not reverse engineer, scrape, overload or interfere with the Service, bypass its limits or safety measures, resell access to it, or use it to build a competing product. We may use automated and human review to detect and block content that breaks these rules.
6. AI-generated content
DupVid uses artificial intelligence, which can make mistakes and produce inaccurate, unexpected or imperfect results. Review every video before you publish it. Where the law or a platform requires it, you're responsible for labeling content as AI-generated or altered. We may add technical markers identifying content as AI-generated.
7. Subscriptions & credits
- Subscriptions are sold through Apple's App Store and billed to your Apple ID. They renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before renewal. Manage or cancel in Settings → your name → Subscriptions.
- Credits are included with your plan (and may be sold separately). They're used to create, remake and upscale videos, as shown in the app before you confirm. Credits have no cash value and can't be transferred or exchanged. Unused plan credits expire when your plan renews and don't carry over to the next period.
- Failed generations: if a video fails to generate because of a problem on our side, we return the credits used.
- Refunds for App Store purchases are handled by Apple under its policies (reportaproblem.apple.com).
- Price changes are communicated in advance through Apple, as required.
- Deleting your data removes remaining credits and does not cancel your subscription.
8. Reports & takedowns
You can report any video in the app. If you believe content made with DupVid infringes your rights or uses your likeness without consent, contact legal@dupvid.app with the details. We review reports and may remove content, restrict features or suspend accounts. Copyright notices should include the information required by applicable law (such as the DMCA in the U.S.).
9. Our rights
DupVid, including its software, design, logos and presets, belongs to us and our licensors. These Terms don't give you any rights to them except to use the Service as described. If you send us feedback, we may use it without obligation to you.
10. Termination
You can stop using DupVid and delete your data at any time. We may suspend or end your access if you break these Terms, create risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable, we'll give you notice. Sections that by their nature should survive termination (such as licenses you granted for legal retention, disclaimers, liability and indemnity) will survive.
11. Disclaimers
DupVid is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, that Outputs will meet your expectations, or that any video will achieve views, engagement or other results.
12. Limitation of liability
To the fullest extent allowed by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50. Some jurisdictions don't allow these limits, so they may not apply to you, and nothing here limits rights you have as a consumer that can't be waived.
13. Indemnity
You agree to defend and indemnify us against claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of Outputs, or your breach of these Terms or the law, to the extent permitted by law.
14. Governing law & disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. Disputes will be resolved by the Harju County Court (Harju Maakohus) in Tallinn, Estonia.
If you're a consumer, this doesn't take away the protection of mandatory consumer laws of the country where you live, and you may also bring claims in the courts of that country. Before going to court, please contact us. Most issues can be solved quickly by email.
15. Apple
These Terms are between you and DupVid, not Apple. Apple isn't responsible for the Service or its content, has no obligation to provide maintenance or support, and isn't responsible for any product or intellectual-property claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you're not located in a country subject to a U.S. government embargo and aren't on any U.S. government list of prohibited parties. In case of conflict with Apple's Licensed Application End User License Agreement, these Terms apply to the extent permitted.
16. Changes
We may update these Terms. We'll change the date above and, for significant changes, notify you in the app. If you keep using DupVid after changes take effect, you accept the new Terms.
